Commercial conditions and structural standards governing the procurement, manufacturing, and site delivery of Bay Bricks Nigeria products. Last updated: July 18, 2026.
1. Acceptance of Terms
These Terms of Service & Commercial Supply (“Terms”) govern all interactions, formal quotations, purchase orders, and material deliveries between Bay Bricks Nigeria Limited (“Bay Bricks,” “we,” or “our”) and our clients, including architects, structural engineers, general contractors, developers, and individual builders (“Client,” “Buyer,” or “you”).
By accessing baybricks.com.ng, requesting a formal commercial estimate, issuing a purchase order, or accepting delivery of our kiln-fired bricks, concrete blocks, cement, timber, or fencing solutions, you agree to be legally bound by these conditions without modification.
2. Product Specifications & Tolerances
Bay Bricks manufactures heavy structural materials to rigorous industrial guidelines. All buyers must acknowledge the physical properties inherent to high-temperature kiln firing and concrete curing:
- Natural Color & Texture Variations: Kiln-fired clay bricks (including Wirecut, Facing, and Perforated variants) undergo intense thermal processing at temperatures exceeding 1000°C. Natural variations in earthy hues, surface textures, and slight tonal gradations between manufacturing batches are characteristic and do not constitute defects.
- Dimensional Tolerances: While manufactured with precision engineering, standard dimensions for bricks, concrete masonry units, and brick tiles are subject to standard industrial dimensional tolerances (±2% to ±3%) as recognized by Nigerian building codes.
- Sample Verification: Physical samples provided prior to order confirm general texture and color profiles; bulk production batches will harmoniously reflect these characteristics within permissible manufacturing limits.
3. Quotations, Pricing & Payment Terms
To maintain transparency across major construction developments, our pricing and financial arrangements adhere to the following framework:
- Quotation Validity: Formal quotations issued via our Quote Form or engineering desks are valid for fourteen (14) business days unless explicitly stated otherwise, after which prices may be adjusted due to fuel, haulage, or raw material cost fluctuations.
- Bulk Discounts: As stipulated on our catalog pages, commercial bulk discounts (5% off unit price) apply exclusively to single-line product orders exceeding one hundred (100) units or palettes, unless special procurement terms have been negotiated in writing.
- Payment Schedule: For standard stock items, full payment or agreed mobilization deposits must clear into Bay Bricks official corporate accounts prior to dispatch from our Ijesha Isu factory or distribution depots. Custom production runs require a mandatory 70% non-refundable engineering deposit upon order confirmation.
4. Delivery, Offloading & Site Access
Bay Bricks coordinates heavy flatbed and crane-assisted haulage to project sites across the 36 states of Nigeria and the Federal Capital Territory (FCT):
- Site Accessibility: The Buyer is solely responsible for ensuring that access roads, bridges, and construction site entrances can safely accommodate heavy multi-ton articulated trucks. Any delays, towing fees, or re-routing charges incurred due to impassable site conditions will be billed to the Buyer.
- Offloading Protocol: Unless special crane-delivery contracts are arranged, offloading is the responsibility of the Buyer and must commence promptly within two (2) hours of vehicle arrival to prevent demurrage charges.
5. Site Inspection & Claims Policy
To guarantee structural integrity at point of delivery, rigorous joint inspection must take place upon arrival:
- 48-Hour Claim Window: Any claims regarding transit breakage, incorrect quantities, or visible structural discrepancies must be documented on the driver's waybill and formally reported to our quality assurance team within forty-eight (48) hours of offloading, accompanied by high-resolution photographic evidence.
- Post-Installation Waiver: Once materials have been laid, mortared, or integrated into a structure, they are deemed conclusively accepted by the Buyer and structural engineer. No claims for replacement or refund will be entertained after installation commences.
6. Structural Compliance & Warranties
Bay Bricks warrants that all structural red bricks, load-bearing concrete blocks, cement formulations, structural timber, and reinforced fencing panels comply with relevant national building standards set forth by the Standards Organisation of Nigeria (SON). Our liability is strictly limited to the replacement of non-conforming goods or refunding the unit purchase price. We assume no consequential liability for labor costs, project delays, or structural alterations resulting from improper handling, incorrect mortar mixing, or poor engineering practices by third-party contractors.
7. Governing Law & Jurisdiction
These Terms and any commercial agreements entered into with Bay Bricks shall be governed by and construed in accordance with the Laws of the Federal Republic of Nigeria. Any commercial disputes that cannot be amicably resolved through executive negotiation shall be subject to the exclusive jurisdiction of the High Courts of Ekiti State or Lagos State, Nigeria.
